Motorcycle Accidents in the Summer

With weather temperatures increasing, four wheeled vehicles will be sharing the road with more motorcycles. The month of May is known as National Motorcycle Safety Awareness Month, which raises awareness for the importance of drivers to be aware of the increased risks of motorcycle casualties and injuries during the summer months.

Motorcycles are smaller vehicles compared to those with which they share the roads and can be difficult to spot for other drivers. This prevents other drivers from yielding when needed, or giving motorcycles the right of way, leading to a surge in collisions. Frequently drivers are on the lookout for vehicles other than motorcycles and can be caught off guard when a motorcycle approaches. Due to the lack of protection on motorcycles, there is a greater chance of a motorcycle rider sustaining a serious injury in a collision.

There are many factors that can result in motorcycle accidents such as speeding, inattentiveness, or vehicles being driven by alcohol-impaired drivers. A driver’s increased use of technology also causes distracted driving on the road, ultimately leading to an increased risk of a collision with a motorcycle. A rider’s injuries can vary depending on the vehicle’s speed, the location of the collision, and whether there were any other proper safety precautions avoided by both the driver and the rider.

The National Safety Council (NSC), which compiles and publishes annual statistics of motorcycle injuries and deaths, reported a total of 4,976 motorcycle rider and passenger crashes in 2015. They also reported 88,000 nonfatal motorcycle injuries within the same year. Additionally, the NSC has compiled data which shows there has been an overall increase in motorcycle accidents over recent years because of the increase in motorcycle riders on the road.

Overall, there seems to be an increased trend of riding motorcycles because of easy accessibility and an increase in popularity. The roads are also seeing an increase in motorcycles by “re-entry riders,” who decide to re-enter the roads again as motorcycle riders, often as older adults who had stopped riding motorcycles at an earlier age.

Help Avoid a Motorcycle Accident With These Riding Safety Tips

While fun to ride, motorcycles present a heightened risk of injury due to a relative lack of protection. According to the Insurance Institute for Highway Safety, motorcyclists face a risk of crashing 30 times greater than drivers of cars.  Moreover, nearly half of all motorcycle-related fatalities result from single-vehicle crashes.

Many motorcyclists nevertheless manage to ride their entire lives without injury. The key is to be prepared in order to minimize risk. Consummerreports.org offers the following tips for avoiding injury while riding motorcycles:

While prevention is obviously preferable, sometimes accidents happen regardless of how careful and alert one may ride. If you or a loved one has been harmed in a collision while riding a motorcycle, please contact Kershaw, Cook & Talley for a free case evaluation at 888-997-5170.

Harley-Davidson Brake Failure Investigation

A few days ago, the National Highway Traffic Safety Administration (NHTSA) launched into a massive investigation of Harley-Davidson motorcycles. After 43 people complained of brake failure, including three reports of crashes and two reports of injuries, the NHTSA has sought to examine 430,000 motorcycles, with model types spanning 3 years (2008-2011).

Thus far, the NHTSA’s investigation says that although some of the brake failures may be attributed to Harley-Davidson’s “2 year brake fluid service interval requirement” the sudden and complete brake failures are still a cause of concern. Whether some riders failed to change the brake fluid as recommended by Harley-Davidson is still unknown. However, riding with old brake fluid may corrode the valves in the anti-lock braking system, impeding the brakes’ functionality. It is also unclear whether it was specifically the anti-lock functionality of the brakes that was failing or whether the entire braking system was malfunctioning. One rider guessed that “If the initial claims are true . . . the failure of the anti-lock braking system [may have] caused complete brake failure.”

A recall has not been announced, as the investigation has only recently went underway and Harley-Davidson is cooperating with investigators. In 2014, the company was forced to recall over 60,000 motorcycles over malfunctioning brakes. This potential problem differs here, in that brakes are failing without any warning, whereas the 2014 recall involved brakes that were engaging unexpectedly. Both problems however, seem to involve the anti-lock braking system.

Brake failure in motorcycles is extremely dangerous and can cause life-threatening injuries. Motorcyclists, even more than motorists, depend on brakes to help them avoid inattentive motorists, debris and slippery surfaces. If you own one of the affected motorcycles, the safest option is to have the motorcycle examined before taking it on the road. If you have been injured due to this defect, a California personal injury attorney knowledgeable in products liability and design defects can provide a consultation regarding your legal options.
