Fatal Car Accident in Wheatland, CA

This morning, a serious collision occurred on Highway 65 near Wheatland in Placer County. According to California Highway Patrol (CHP), the three car, head-on accident occurred after a woman driving southbound on Highway 65 crossed over the double yellow lines into incoming traffic. After the motorist crossed the double-yellow center line she struck an SUV head-on, which then spun out of control and was hit by a nearby pickup truck. The woman died at the scene, while the man in the SUV was airlifted to a nearby hospital with life threatening injuries. The driver and passenger of the pickup truck were not injured. Both Directions of Highway 65 were closed as a result of the accident, reopening about two hours later.

Although it has not yet been determined what caused the driver to veer of course, California Highway Patrol has determined common causes of collisions. Alcohol, for example, was involved in about 90 fatal collisions in 2013. Placer County specifically, had 105 injuries and 4 fatalities involving alcohol and motor vehicles in 2013. Fatal collisions are also often caused by collisions with trucks. In 2013, 256 such fatalities occurred.

In California, drivers owe others on the road, including pedestrians and other vehicles, a duty to drive reasonably. The failure to drive reasonably, such as by failing to look out for obstacles or control the speed of the vehicle, may result in negligent driving. Contact a California personal injury attorney if you have recently been involved in a collision for a consultation regarding your legal rights.

65-year old woman found dead after hit-and-run in Gibson Ranch

On the morning of Saturday, June 18, the body of a 65- year old woman was found in a ditch in the Elverta area near Gibson Ranch, California. Police later identified the body as that of Donna Zurfluh, who was walking on the south side of Elverta Road between 2am and 6am when she suffered a hit-and-run collision. The stretch of road she was walking did not have a pedestrian path, and was dark when she was killed. The speed of the vehicle and cause of the collision have not yet been determined. Ms. Zurfluh served her community by teaching adults with special needs and running a recovery program for people struggling with substance abuse – we extend our sincere condolences to Ms. Zurfluh’s family and community who are undoubtedly feeling the pain of loss in her absence.

Pedestrian Injury Statistics

According to the National Highway and Traffic Safety Administration (NHTSA), most pedestrian deaths occur between 4pm and midnight during weekdays, while most weekend fatalities occur between 8pm and 4am. Males seem more likely to suffer fatalities as pedestrians, with 70% of pedestrian fatalities in 2011 being male. Roughly one-fifth of children 10 to 15 years old killed in traffic accidents were pedestrians, with roughly the same figure holding true for those 65 and older. 62% of those involved in pedestrian fatalities were adults ranging from the ages of 21 and 64. Alcohol seems to be a significant factor in these pedestrian fatalities, with 37% of pedestrians killed in 2011 having BACs of .08 g/dL or higher at the time of the accident.

Victim’s Legal Rights

In addition to criminal sanctions for fleeing the scene of accident, drivers can be subject to civil penalties for causing harm by breaching their ordinary duty of care. In situations involving automobiles, drivers owe a heightened duty of care due to the dangerous nature of high-speed automobiles. If you, or a loved one, suffered injuries in an automobile accident, and you believe the driver failed to act with ordinary care, call a California personal injury attorney to receive the help you need and deserve.

Alejandro’s Taqueria in Fairfield Linked to Food Poisoning

On Wednesday, June 8, California Public Health Officials closed Alejandro’s Taqueria, a popular Mexican food restaurant in Fairfield, California in order to investigate a Campylobacter outbreak. The Solano County Department of Health has found 32 cases of food poisoning with one common denominator: Alejandro’s Taqueria. Although officials have identified the location where people became ill, they are still working on locating the exact source of the bacteria. Investigators believe under cooked meat is a likely source, but have yet to establish this as a certainty.

Campylobacter jejuni is a bacterial organism known to be the most common cause of food-borne illness in the U.S.  The symptoms can occur within two to five days after being exposed to the bacteria. Most cases of Campylobacter infection occur as isolated, sporadic events, and not as part of a large outbreak. Even though surveillance is limited, about 14 cases are diagnosed each year for every 100,000 persons in the population.

The Centers for Disease Control and Prevention (CDC) provide tips on preventing a Campylobacter infection:

Legally, a claimant who alleges that they contracted food poisoning after consuming contaminated food at a restaurant does not need to rule out all other possible sources of food poisoning. They must, however, establish enough evidence to permit a jury to find causation based on reasonable inferences that apply generally in other types of tort actions.  Those who contracted the bacteria would be well advised to contact an experienced California personal injury lawyer who will fight for their rights, ensure that they are fairly compensated for their suffering and hold the negligent party liable.
