Two Dead in California Greyhound Bus Crash

San Jose, California- On Tuesday, January 19, during an early morning commute, a Greyhound bus flipped on its side killing two women, and seriously injuring and hospitalizing eight passengers. A few individuals sustained minor injuries and were treated on site. The bus was carrying 20 passengers and the driver.

The bus initially left Los Angeles at 11:30PM on Monday, January 18 and was travelling north on Highway 101 in San Jose when it rolled and crashed into the concrete, center divider at approximately 6:30AM on Tuesday. No other vehicles were involved. The National Transportation Safety Board (NTSB) sent a team to investigate the crash. However, the driver was reportedly fatigued and “nodding off” before the crash. He denies falling asleep. Authorities confirm the driver was not under the influence of drugs or alcohol.

U.S. Department of Transportation data shows Greyhound buses have been involved in six fatal accidents resulting in seven deaths over the past two years. When a vehicle collision occurs, oftentimes the at-fault party or parties can be held liable for the injuries and losses that occur as a result of negligence.  Additionally, when the at-fault party is a common carrier, such as a Greyhound bus, the standard of care that must be used in transporting its passengers is elevated.  A common carrier must use the highest care and the vigilance of a very cautious person when transporting its passengers.

Common carriers must keep up with modern improvements and must adopt commonly accepted safety designs and devices in the vehicles and equipment they use for transporting passengers.  Moreover, the standard of care for common carriers is further heightened when transporting disabled persons or children.
